يقوم التصور الفقهي في الإسلام على اساس: "أن ما من واقعة إلا ولها حكم". وهذا إن دل على شيء فإنما يدل على مواكبة الفقه الإسلامي للتصور الحديث والعلم الحديث، وهكذا كان السيد محمد الصدر في معظم مؤلفاته التي يبدو بها جلياً أنه بالإمكان تطبيق الفقه الإسلامي في كل الكون سواء على وجه الأرض أو غيره. فبرأيه الإسلام ليس ديناً ارضياً فقط بل هو دين سماوي المصدر وسماوي التطبيق أيضاً.
يدخل هذا الكتاب في حقل (المسائل المستحدثة) التي يحتاج فيها الفقيه إلى ذكر تفريعاتها ومسائلها وهو ما أكده المؤلف في مقدمة الكتاب بقوله: "حاولت أن لا أذكر عدداً كثيراً من التفريعات (...) وإنما اقتصرت على التفريعات والمسائل والأنسب والأقرب إلى الحياة العملية، مع ضمنها إلى أمور فضائية قد لا يطول الزمان لحصول الإنسان عليها ووصوله إليها(...) فإذا كان في القضاء الإلهي أن تحصل في المستقبل، فسيكون البت فيها وإظهار حكمها موكولاً إلى فقهاء ذلك العصر...".
