إنّ ما يميز التحكيم التجاري الدولي إذن هو أنه "عدالة خاصة" c'est une justice privée يقوم بها أشخاص عاديون من إختيار أطراف المنازعة أنفسهم على أساس توفر خصائص معينة فيهم، تتعلق أساساً بكونهم يحوزون خبرة أكيدة في مجال الممارسة التجارية الدولية، ويطبقون فيها القانون الذي يمليه إختيار الأطراف.
لكن في الإطار الذي حددنا فيه موضوعنا، وهو التحكيم التجاري الدولي المؤسساتي، يتدخل متغير آخر في العملية التحكيمية، وهو الأنظمة التحكيمية للمؤسسات، والتي تلزم الأطراف بمجرد إختيارهم لعرض النزاع على المؤسسة التحكيمية التي وضعتها.
هذه الأنظمة تضع قواعد دقيقة تتضمن حلولاً لمعالجة مسألة كيفية تعيين المحكمين للفصل في النزاع، وتضع القواعد الواجب إتباعها من طرف للمحكم لحل تنازع القوانين المتعلقة بالعقد.
لذلك، فإن دراسة هذا الموضوع، ستتمحور حول الدور الذي تعطيه هذه الأنظمة التحكيمية للمؤسسة في مجال تعيين المحكمين مقارنة بدور أطراف النزاع من جهة، والسلطة التي تعطيها للمحكم في إختيار القانون الواجب التطبيق على النزاع، من جهة ثانية.
على هذا الأساس قسمنا الموضوع إلى ثلاثة مباحث: الأول: مبحث تمهيدي لتوضيح مفهوم التحكيم التجاري الدولي وأنواعه لتبيان مميزات التحكيم التجاري المؤسساتي، الثاني: مخصص لدراسة سلطة تعيين المحكم على ضوء الأنظمة التحكيمية، في مرحلة التشكيل الإبتدائي للمحكمة التحكيمية، ثم في مجال معالجة الإشكالات اللاحقة له.
الثالث: مخصص لدراسة سلطة المحكم في إختيار القانون الواجب التطبيق على النزاع.
