في كتابه هذا ، يبحث الدكتور قيس بن محمد آل الشيخ مبارك في رأي الشرع من موضوع "إنشاء سر المهنة المصرفي"، ذلك أن الأصل في المعاملات المصرفية أنها سرٌّ بين المصرف والعميل، والواجب في السر كتمانه وعدم البوح به، فإنشاء المصرف لِما تدعو الضرورة لكشفه، وإظهاره لشيءٍ من أسرار العميل يعدُّ معصيةً توجب تأثيم فاعلها.
انطلاقاً من هذه النظرة يوضح المؤلف طبيعة المهن المصرفية، وما يترتب عليها من معاملات مصرفية، وما تدعو الضرورة لكشفه والإطلاع عليه، وما لا تدعو الضرورة لكشفه والإطلاع عليه من خلال انتخابه لنماذج من أنواع المعاملات المصرفية، ومن خلال ما يورده من آيات قرآنية وأحاديث شريفة مما نصها علماء الدين حول عظيم شأن الأمانة ، وضرورة حفظ السر المصرفي، وهو ما نصّت عليه أصلاً "مؤسسة النقد" . وبناءً عليه، يرى المؤلف: استناداً إلى ما نص عليه الفقهاء من ضرورة حفظ الأسرار، فإن المصرف مؤتمن على جميع البيانات الخاصة بالعملاء، كالحسابات الجارية، وحسابات التوفير، والودائع، والأمانات، والخزائن. فهذه كلها أماناتٌ يجب الستر عليها، فلا يُباح الكشف عنها إلا بإذنه ، أو بوجه شرعيٍّ صحيح، كتعويض المودع لأحد أولاده أو اقاربه أو غيرهم بذلك.
