إنّ دين الله عظيم، وشرعه قويم، أرسل الله به رسوله الكريم للناس أجمعين، رحمة لهم إلى يوم الدين، وأمرهم باتباعه، طاعة لله سبحانه وتعالى، وإظهاراً للحق وتحقيقاً للعدالة. أباح الإسلام الزَّواج، وحث على تكوين الأسرة الصالحة، التي هي عماد المجتمع، ولبنته الأساسية، وأمر الزَّوْج بمعاشرة زوجه بالمعروف، ونهاه عن الإضرار بها، وأمر الزَّوْجَة بطاعة زوجها من غير معصية، وأرشدهما إلى ما فيه صلاحهما عند حدوث الخلاف، وجعل آخر حلول الخلاف الطَّلاق، حسماً للمشكلات، وخوفاً من المحظور.
وَقَيَّدَ الشَّرع الزَّوْج بطلقتين، يستطيع بعدهما إرجاع زوجته إلى عِصْمَتِهِ وعَقْدِ نِكاحِهِ ــ إذا كان قد دخل بها ــ بعد الطلقتين؛ إمساك بمعروف، أو تسريح بإحسان، فإن كان التسريح، فلا تحل له من بعد حتى تنكح زوجاً غيره.
ويمكن أن يكون الطلاق قبل الدُّخول أو بعده، بلفظ صريح أو كناية، بلفظ واحد أو متعدد، في مجلس واحد أو في عِدّة مجالس، في حالة يقع بها الطَّلاق أو لا يقع، وقد يكون الطَّلاق في المَحْكَمَة في مجلس القاضي وقد يكون في غير مجلسه، وقد يُسَجِّل الزَّوْج طلاقه في المَحْكَمَة وَيُوَثِّقَه، وقد لا يفعل، بل قد ينكر أنَّه طلق، فإن ادُّعِيَ عَلَيْه بهذا الطَّلاق فلا بُدَّ أن تسير المَحْكَمَة في الدَّعوى حَسْبَ الأصول والوجه الشَّرْعِي، حتى يتم الفصل فيها.
