بحكم عمله في إدارة مكتب القضايا الشرعية في المجلس الإسلامي الشيعي الأعلى، يسلط السيّد علي مكي العاملي الضوء على ظاهرة إجتماعية تزداد يوماً بعد يوم وهي (الطلاق) ويدرس أسبابها ويبحث في دور الشريعة والحاكم في لجم جموح هذه الظاهرة الخطرة.
وفي الكتاب يلقي المؤلف نظرة على قرانا في الجنوب اللبناني ليجد "إنه من بين كل خمس عشرة حالة زواج يوجد سبع حالات طلاق ففي منطقة النبطية الشاملة لحوالي أربعين قرية تقريباً سجل عدد الطلاق الرسمي وغيره خمسمائة حالة سنوياً من أصل 1500 حالة زوجية ... ومن صيدا سجل القلم 231 حالة مقابل 701 حالة زواج وهلم جراً ...". هذا الواقع هو ما جعل المؤلف يرصد هذه المشكلة ويناقشها لأهميتها وخطرها على الزوجين والمجتمع ككل وتقديم التوعية الشاملة للحيلولة دون الوقوع بأبغض الحلال عند الله (الطلاق) وسيلته في ذلك العودة إلى تعاليم الدين الإسلامي الصحيح والقوانين التي تعالج هذا الموضوع، لمعرفة حقوق الطرفين قبل وبعد وقوع الطلاق، من دون أن ينسى دور التنشئة الإجتماعية الجيدة للأبناء وتثقيفهم وإرشادهم إلى مسؤولياتهم الزوجية وحكم الشرع وحقوق الطرفين عند وقوع الطلاق.
توزع الكتاب على ثلاثة أقسام جاء القسم الأول بعنوان (الطلاق خطيئة من؟) ويضم اربعة فصول هي: 1- حقائق وآلام، 2- أسباب الطلاق، 3- الشريك الصالح، 4- حلول توصيات. القسم الثاني وجاء بعنوان (الطلاق والحاكم الشرعي) ويضم صوراً عديدة عن حالات الطلاق مثل: طلاق الحاكم: في صورة الإمتناع من النفقة عن قدرة، طلاق الحاكم: في صورة غياب الزوج، طلاق الحاكم: بعلة الإرتداد ... وغيرها. ويأتي القسم الثالث والأخير بعنوان (الرجعة والعدة والعزل والمقاربة وطلاق الحاكم) ويضم أحكام: حول الطلاق وروايات عن أهل البيت وأسانيدهم في هذا الكتاب من نفقة وعدة مع أمثلة ...
