تمثل جريمة الإتجار بالبشر إحدى أهم التحديات الكبرى التي تتعرض لها المجتمعات، والتي تجعل الحياة الإنسانية سلعة متداولة بين الناس على مختلف أجناسهم وإنتماءاتهم، وذلك من خلال تحديد قيمة مالية لحياة الإنسان وحريته سواء أكان رجلاً أو امرأة أو طفلاً، وأنها تمثل الوجه الأخر للرق والعبودية وإنتهاكاً واضحاً لحقوق الإنسان بكل شكل من أشكاله، ويتمثل في كونه إستغلال إنسانية وجسد وجنس الضحية من الشخص المتاجر بها، سواء كان إعتداء جنسي أو عمل إجباري أو تسول أو إسترقاق أو تجارب الطبيعة ونحوها، والضرر الواقع هنا ضرر مادي وأدبي في آن واحد، وتدخل في إطار الجريمة المنظمة التي تمارسها العصابات الدولية، وقد أصبحت ظاهرة عالمية ومعقدة ومتداخلة في إطار عالمي يخرج عن الوطنية ويخرج عن حدود فئة معينة من الأشخاص فهو كالآفة أصابت جميع فئات المجتمع سواء أطفال أو نساء أو رجال، إلا أن الإحصائيات العالمية أشارت إلى أن أكثر فئات المجتمع تعرض لهذا النوع من الجرائم هم الأطفال والنساء، ويعتبر الإتجار بالبشر ثالث أكبر نشاط إجرامي في العالم بعد تجارة السلاح والمخدرات وهو أسرعها نمواً وفقاً لتقرير الإتجار بالبشر لوزارة الخارجية الأمريكية الصادر عن مكتب مراقبة الإتجار بالبشر ومكافحته 14 حزيران 2004.
