من خلال هذا الكتاب - مع بيان الإختلافات الفقهية وآراء الفقهاء - حول تعريف الغصب والتمثيل عليه من واقعهم وفي زمانهم من أمثلة عديدة، فإن الواقع العملي يشهد تطبيقات حديثة فيم وضوعها ومحالها لم يذكرها الفقهاء السابقون، ذلك أن الحداثة وتطورات الحياة الإقتصادية أفرزت العديد من الإشكالات القانونية حول موضوع غصب الأموال، وهو ما سيركز عليه هذا الكتاب، ومن أمثلة ذلك غصب الدولة للعقارات المملوكة إذا ما استولت على تلك العقارات دون الإلتزام بقانون الإستملاك، والتصرف في المال المملوك على الشيوع من بعض الشركات دون الحصول على موافقتهم، وما يثور حول هذه المواضيع من خلافات وإجتهادات، وكذلك على سبيل المثال أهمية معرفة الأفعال التي هي في حكم الغصب مثل تحول يد الأمانة إلى يد غاصبة، كالوديع والمستعير والمستأجر إذا تعدى على المال المودع لديه أو المعار إليه او المال الذي استأجره، أو حكم يد المشتري على المبيع بعقد بيع باطل، وكذلك الإشكالات التي تثور حول محل الغصب إذا كان مالاً له خصوصية معينة كالحقوق الأدبية التي يقدر لها قيمة مالية كبيرة، ومدى إعتبارها في أن تكون عُرضةً للغصب ومحلاً له.
فهذه مستجدات بحاجة إلى ان يتم بحثها بحثاً قانونياً على ضوء الإشكالات التي تثور حولها وفي ظل النصوص القانونية القائمة والإجتهادات القضائية بهذا الصدد.
