برزت قضية الأسرى الفلسطينيين والعرب في سجون الإحتلال الصهيوني بإحتلال فلسطين من قبل البريطانيين ثم الصهاينة بعد سقوط دولة الخلافة وغياب الحكم العثماني الإسلامي لفلسطين؛ انطلقت منذ اللحظة الأولى للإحتلال الأعمال المقاومة للمحتل من مواجهات ومسيرات وإحتجاجات وأدى هذا إلى شهداء وأسرى، وبدأ جهاد الأسرى ضد السجن والسجان.
استحضر الكتاب الإتفاقات والقرارات الدولية التي تثبت أن فلسطين محتلة من قبل كيان إحتلالي غير شرعي ويحق لأهل فلسطين ومقاومته بكافة الأشكال والأساليب وعلى رأسها المقاومة المسلحة، وتعرض الكتاب للقرارات الدولية التي تشرع لكل شعب محتل إستخدام القوة لتقرير مصيره وإختيار الحكم الذي يرتأيه، وقدّم الكتاب لمحة عن محكمة العدل الدولية وتبين أن هذه المحاكم الدولية تكيل بمكيالين خاصة إذا تعلق الأمر بالكيان الصهيوني وفلسطين وأهلها.
واستعرض الكتاب القوانين في الإتفاقات والمعاهدات والمواثيق الدولية التي تضمن حق الشعوب في المقاومة وحق تقرير المصير للشعوب والأمم، إن التأسيس لموضوع الأسرى استلزم التقديم بتعريف الإتفاقات والمواثيق الدولية التي تضمن للشعوب مقاومة المحتل الخارجي ولا يُنسخ هذا الحق لأهل فلسطين بمفاوضات أو مساومات.
واستعرض الكتاب مراحل تطور الإتفاقات الدولية الخاصة بالأسرى بدءاً من إقتراح قيصر روسيا على بريطانيا عام 1816 خفض القوات المسلحة مروراً بإقتراح نابليون الثالث عام 1863 ومؤتمر لاهاي 1907 حتى إتفاقات عام 1949.
واستعرض الكتاب إتفاقية فيينا للأسرى ولاهاي، وعرض خرق الإحتلال لهذه الإتفاقية وبنودها فيما يتعلق بمكان إحتجاز الأسرى والتعذيب والنساء والأطفال والزيارات والمرضى والجرحى والإعدام وحرية العبادة والمحاكم وغيرها.
وركز الكتاب على خرق الإحتلال الصهيوني لإتفاقات جنيف الدولية الثالثة والرابعة المتعلقة بالأسرى وإتفاقية حق الطفل، لم يترك المحتل - كما سيعاين القارئ الكريم بنفسه - أي بند من بنود الإتفاقات الدولية إلا وانتهكها كما ستبين شهادات الأسرى المتعددة والمؤرخة والموثقة.
وجاء الكتاب ليسلط الضوء على خرق الإحتلال لكل الإتفاقات والوثائق والمعاهدات الدولية الخاصة بأسرى المقاومة وحقوق الإنسان والطفل ورفض كل خلط مغرض ومشبوه بين المقاومة والإرهاب.
