في السابع عشر من تموز عام 1998م أختتمت أعمال المؤتمر الدبلوماسي المعني بإنشاء محكمة جنائية دولية بالموافقة على تبني نظامها الأساسي، وفي اليوم التالي افتتحت الاتفاقية للتوقيع بمدينة روما الإيطالية، وكان الغرض من ذلك إنشاء محكمة تختص بالتحقيق ومحاكمة مرتكبي الجرائم الخطيرة موضع اهتمام المجتمع الدولي بأسره ووفقاً للنظام الأساسي، دخلت اتفاقية انشاء المحكمة حيز التنفيذ في الأول من تموز عام 2002م.
ونظراً لأهمية هذا الموضوع جاء كتابنا يبحث في النظام القضائي للمحكمة الجنائية الدولية؛ وذلك في بابين، يسبقها تمهيد، نوضح فيه التطور التاريخي للقضاء الدولي الجنائي، وسنتناول في الباب الأول تكوين المحكمة وعلاقاتها، فندرس في الفصل الأول منه تشكيلاتها المتمثلة بالهيئة القضائية وهيئة الإدعاء العام، كما ندرس علاقة المحكمة بالأمم المتحدة وبالدول في فصله الثاني، ونتناول في الباب الثاني إجراءات المحكمة الجنائية الدولية، ونقسمه بدوره إلى فصلين، نخصص الأول لدراسة تلك الإجراءات في مرحلة ما قبل المحاكمة، ونخصص الثاني لدراستها في مرحلة المحاكمة وما بعدها، ثم نختتم دراستنا بخاتمة تتضمن أهم النتائج والآراء التي أثمرت عنها.
