إن السياسة العقابية تبيّن المبادىء التي يتوقف عليها تحديد العقوبات وتطبيقها وتنفيذها، وتحديد العقوبات يتم مكملاٌ للتجريم الذي لا يقوم وحده بدون العقوبة ويستأثر به المشرّع، ولذا سماه البعض بالتفريد القانوني. أما تطبيق العقوبات وتنفيذها فيتم في مرحلتين متعاقبتين هما التطبيق القضائي والتنفيذ العقابي، ولذا سمي بالتفريد القضائي والتفريد التنفيذي.
وتحدد السياسة العقابية الهدف من العقوبات في مراحلها الثلاثة المتعاقبة قانونياً وقضائياً وتنفيذياً وتبين وسائل تحقيق هذا الهدف.
وتتكون السياسة العقابية في مقام تحديد وسائل تحقق الهدف من العقوبات في شقين:
الأول: موضوعي بحت ويتناول الصورة المجردة للعقوبات في مرحلة التشريع والأهداف الواجب اتباعها في مرحلة تطبيقها أو تنفيذها.
والثاني: إجرائي بحث ويتناول الإجراءات الواجب اتباعها للفصل ابتداء في مدى توافر حق الدولة في العقاب، ثم الإجراءات المعمول بها عند تطبيق العقوبات وتنفيذها طبقاً للأسس الموضوعية المحددة لها.
وفي هذا السياق يبحث الدكتور جمال الحيدري، استاذ القانون الجنائي، في موضوع "علم العقاب الحديث" وذلك في مقدمة ومبحث تمهيدي وثلاثة فصول. وقد جاء توزيع فصول الكتاب وفق ما يلي: المبحث التمهيدي: التعريف بعلم العقاب؛ الفصل الأول: المؤسسات العقابية؛ الفصل الثاني: دور المؤسسات العقابية في تنفيذ الجزاءات الجنائية، الفصل الثالث: أساليب المعاملة العقابية.
