Book Description
تعد المسائل العارضة من المشكلات العملية الهامة التي تحصل في إجراءات الدعوى الجزائية، وما تثيره تلك المشكلات من عرقلة لسير العدالة نتيجة لإستئخار الدعوى الجزائية ومن ثم بقائها معلقة دون صدور حكم فيها، وهذا تعطيل لسير العدالة، أو أن المحكمة الجزائية قد تصدر حكماً بشأن صورة من صور هذه المسائل دون أن يكون لها الإختصاص في ذلك، وهذا مجافاة للعدالة أيضاً.
إن أهم ما تثيره المسائل العارضة من إشكالية هو أنها في الغالب تكون ذات طابع مدني - بمعناه الواسع - وبالتالي فإنها وفقاً للقواعد العامة في الإختصاص الوظيفي تخرج من إختصاص المحكمة الجزائية، لا بل زيادة على ذلك فقد تكون المسائل العارضة ذات طابع جزائي، ولكن ليس للمحكمة الجزائية أن تفصل فيها.
لذا، وبطبيعة الحال، فإن هناك تساؤلات تثار بشأن الموضوع، ومنها هل تختص المحاكم الجزائية بالفصل في المسائل العارضة إذا ما أثيرت أمامها أثناء نظر الدعوى الجزائية؟ فإن كانت الإجابة بالإيجاب، فما هو الأساس الذي يقوم عليه هذا الإختصاص؟ وما هي الحالات التي تختص بها؟ وإذا ما تعرضت إليها الفصل، فهل يتم إثباتها وتفسيرها وفقاً للمبدأ العام في الإجراءات الجزائية وهو حرية القاضي الجزائي في الإثبات أو الإقتناع؟ أم عليها أن تلتزم قواعد معينة في الإثبات؟ وإذا ما انتهت إلى إصدار قرار بشأنها، فما مدى حجيته أمام الجهة المختصة؟.
وإذا كانت الإجابة بالنفي فهل هناك شروط لا بد من توافرها للقول بعدم إختصاص المحكمة الجزائية؟ وما هي حالاته؟ وما هي الإجراءات الواجب إتباعها لإحالة هذه المسألة إلى المحكمة المختصة؟ وإذا ما صدر حكم بشأنها من الجهة المختصة، فهل يحوز قوة الشيء المحكوم عليه أمام المحكمة الجزائية؟.
وعلى كل الأحوال، هناك تساؤلات عدة تطرح نفسها بشأن هذا الموضوع ستتم مناقشتها ومواجهتها من خلال دراسة هذا البحث وفي ضوء ما جاء به القانون والقضاء والفقه.
