الإرهاب باعتباره ظاهرة إجرامية أو سلوكاً منحرفاً عن قواعد السلوك الاجتماعي السائدة في المجتمع، وذلك تأسيساً على أن السلوك الإجرامي ليس مجرد واقعة يجرمها القانون فحسب، ولكنه سلوك يصدر من إنسان يعيش في بيئة معينة ووسط مجتمع معين، ومن ثم فهو سلوك اجتماعي منحرف، لذلك فإن دراسة أسباب الإرهاب ودوافعه تعطي التفسير لهذه الظاهرة وبالتالي، فإن هذا التفسير ينطبق عليه ما يقال عن تفسير الظاهرة الإجرامية بصفة عامة، حيث إن الجريمة ترجع إلى، بل تنبع من مصادر عديدة متنوعة ومتشابكة ومعقدة. والإرهاب لا يقتصر على دولة دون أخرى أو على منطقة معينة دون غيرها، بل إنه يضرب في كل مكان، ويستخدم الأسلحة الممكنة كافة، مستفيداً إلى حد كبير من التقدم العلمي في مجال التقنية والاتصالات.
وظاهرة الإرهاب ليست فكرة ذات طبيعة قانونية فقط[1]، وإنما هو واقع سياسي واجتماعي في كثير من الدول مستمداً مصدره من جوهر المفاهيم السائدة في المجتمع الذي يعيش فيه. ومن منظور العدالة الجنائية، تساعد سياسات وقوانين مكافحة الإرهاب التي تستند إلى حقوق الإنسان على تعزيز ملاحقة الأفراد المتورطين في أعمال إرهابية أمام القضاء وإدانتهم وفقاً للإجراءات المقررة قانوناً. كما تساعد على تحقيق تناسق النصوص القانونية وعدم تضاربها والتي تطبقها مختلف المحاكم الوطنية، ما يسهّل التعاون الدولي. وفي المقابل، فإنّ التساهل في موضوع حقوق الإنسان يؤدي إلى تآكل سيادة القانون وإلى تقويض فاعلية أي تدبير لمكافحة الإرهاب.
والمجتمع كما يهمه عقاب المتهم والاقتصاص منه في حال ثبوت الجرم في حقه، يهمه أيضاً ألا يشمل العقاب بريئاً. لذا يجب في حال تنظيم الإجراءات الجنائية – في دولة القانون- مراعاة مصالح المجتمع وصونه من الإجرام والحد من تفاقمه، وكذلك حقوق الأفراد وحرياتهم. وفي حال بلوغ هذا التوازن يمكن القول بأن التنازع بين حق الدولة في العقاب وحق المتهم في الحرية الفردية أصبح تنازعاً ظاهرياً يعبّر عن وجهين لعملة واحدة.
