الدفاع عن المظلوم رسالة سامية جليلة خصوصًا في ساحة القضاء عندما يكون حبيسًا في قفص الاتهام لا يملك حراكًا. وتعني الشرائع المتحضرة بكفالة حق الدفاع أثناء التحقيق والمحاكمة على أقوى صورة. وقد بينا في مقدمة هذا المؤلف كيف أن الهدف الأوحد لكل قانون إجرائي هو ضمان الوصول بسفينة الدعوى الجنائية إلى بر الأمان رغم ما قد يحيط بها من عواصف التضليل والبهتان، وما يتهددها من عوامل العثار أو الطغيان.
حق الدفاع في الدعوى الجنائية موضوع خطير متعدد الجوانب محتاج إلى مجلدات ضخمة للإحاطة به على الوجه المطلوب، وذلك ما يضيق عنه بطبيعة الحال نطاق باب يخصص له بين أبواب المشكلات العلمية الهامة للإجراءات الجنائية في بلادنا. لذا قصرنا هذا الباب على دراسة قضائية صرف لحق الدفاع في مرحلتي التحقيق الابتدائي والمحاكمة وحدهما. هذا وقد رأينا أن نتناول موضوعات هذا الباب في أربعة فصول على النحو الآتي: [الفصل الأول: في نشأة حق الدفاع وأهميته وتأصيله، الفصل الثاني: في حق الدفاع في مرحلة التحقيق الابتدائي، الفصل الثالث: في حق الدفاع في مرحلة المحاكمة، الفصل الرابع: في نظرية الطلبات والدفوع بقدر اتصالها بحق الدفاع].
