يعد حق حل البرلمان وسيلة رقابية في غاية الأهمية والخطورة، فهو قد يكون مظهراً من مظاهر الديمقراطية إذا استخدم في إطاره الدستوري وهنالك ما يبرر اللجوء لديه لحسم النزاعات التي قد تنشب بين السلطات العامة ويتم ذلك من خلال الرجوع إلى الشعب ليقول كلمته في الإنتخابات العامة، وبذلك يتحقق الهدف المرجو منه وهو الحفاظ على التوازن بين السلطتين التشريعية والتنفيذية، وفي الوقت نفسه قد يكون أداة لتسلط الحكومة على البرلمان ووسيلة لتحقيق المآرب والسياسات الشخصية للجهة المختصة بالحل تجاوزاً في ذلك عن حدودها الدستورية.
فإستخدام حق الحل وفق الحالة الأخيرة يساعد على تقوية مركز السلطة التنفيذية على حساب السلطة التشريعية ويشوه بذلك التوازن المطلوب بين السلطتين في النظام البرلماني.
عليه، فإن فقدان التوازن بين السلطتين بسبب تسلط السلطة التنفيذية بإستخدام حقها في حل البرلمان في غير موضعه موضوع جدير بالدراسة.
ومن جهة أخرى تعد دراسة الآثار القانونية المترتبة على حل البرلمان على إستمرارية أعمال الدولة من المسائل المهمة في القانون الدستوري، وتظهر ملامح هذه الآثار من خلال تحديد الأوضاع القانونية للحكومة والبرلمان المنحل، ولم تضع معظم دساتير الدول البرلمانية ضوابط معينة لهذا التحديد.
عليه، تتجه هذه الدراسة نحو إيجاد تنظيم دقيق لهذه الإشكالية الدستورية وذلك تفادياً لأحداث الفراغ التشريعي والرقابي من الجهة وضمان إستمرارية أعمال الحكومة من جهة أخرى.
قسمت هذه الدراسة إلى ثلاثة فصول، خصص أولها لدراسة النطاق القانوني لحق حل البرلمان وكيفية نشأته في النظام البرلماني، أما الفصل الثاني فجاء عنوانه مبررات حق الحل وضماناته الدستورية، يعرض المبررات السياسية والفنية لحق الحل، أما الفصل الثالث والأخير فقد خصصه لدراسة الآثار القانونية لحل البرلمان على مبدأ إستمرارية أعمال الدولة.
وقد جاءت الخاتمة لتبين أهم ما توصل إليه البحث من الإستنتاجات وعرض جملة من الإقتراحات.
