Book Description
"الفتح الجلي في القضاء الحنبلي" رسالة فريدة في بابها، عزيزةٌ عند طلابها، تختص بسرد أسماء قُضاة الحنابلة بمدينة دمشق الغراء، لمؤلفها مفتي الحنابلة وقاضيهم بدمشق، العلامة، الفقيه، المؤرخ، الشيخ محمد جميل بن عمر الشطي الدمشقي، الحنبلي، المتوفى سنة 1379هـ.
أما عن سبب تأليفه هذه الرسالة فيقول العلامة الحنبلي: "إني لما وليتُ نيابة القضاء الحنبلي في "محكمة السنانية" ثم في "المحكمة العونية" مِنْ محاكم دمشق الشرعية، خطر لي أن أجمع هذه الألوكة فيمن وَلوا القضاء المذكور، لتكون ذكرى في بابها، وخدمةِ لطلابها، ثم يبدأ بشرح مهام قضاة الحنابلة في دمشق إلى سنة (922هـ) فيقول: "كانت تُنصب من طرق الدولة المصرية... ثم بدخول السلطان العثماني - طاب ثراه - إلى الشام في السنة المذكورة، وتفويضه قضاءها إلى قاضٍ واحد من الحنفية، صار إنما ينصبُ قضاة للحنابلة وغيرهم من ذلك القاضي الحنفي، فصار يوجد منهم في محاكم دمشق قاضٍ وأكثر...".
ومن هؤلاء يسرد المؤلف أسماء (58) قاضياً أو لهم شيخ الإسلام، شمسُ الدين عبد الرحمن بن أبي عمر بن قدامه للفترة 0664هـ - 76هـ) وآخرهم الشيخ توفييق ابن الشيخ سعيد السيوطي الذي تولى نيابة القضاء في محاكم دمشق سنة (1327هـ)، وأما عن (سلسلة الإفتاء الحنبلي في دمشق) فيذكر المؤلف سبعة عشر مفتياً وأولهم شهاب الدين أحمد الشويكي (ت 939هـ) وآخرهم الشيخ أحمد الشطي وتوفي سنة (1316هـ).
هذا، وقد أضاف المؤلف إلى خاتمة الرسالة سلسلة سند الفقه الحنبلي الموصل إلى الإمام أحمد بن حنبل رضي الله عنه بمشاهير رجال المذاهب الحنبلي إلى إمتداد تاريخهم.
