تختص هذا الكتاب بدراسة الحقوق العينيَّة بنوعيها الأصليَّة والتَّبعيَّة، ويتًّسمُ هذا الموضوع بسماتٍ عدًّةٍ، منها إستقلاليته - بعض الشَّيء - عن موضوعات القانون المدني الأخرى المتمثّلة في مصادر الإلتزام وأحكام الإلتزام والعقود المسمَّاة، لأنَّ هذه الموضوعات تختصُّ بدراسة الحقِّ الشَّخصي؛ وكنتيجة لهذه الإستقلاليَّة.
فقد تضمَّن هذا الموضوع الكثير من المفاهيم القانونيَّة الَّتي لم يسبق للطَّالب التعرُّف عليها كالملكيَّة والشٌّفعة والحيازة والرَّهن وغير ذلك، ومن سمات هذا الموضوع أيضاً كثرة المفردات الَّتي يحتويها والَّتي لا تتَّسع لدراستها سنة كاملة، فكيف بدراستها في فصلٍ واحدٍ كما هو معتمد في الجامعات الأردنيَّة.
وقد اتَّسمت هذه الدِّراسة بالتَّركيز على نصوص القانون المدني الأردني والقوانين الأردنية الخاصَّة ذات العلاقة، وإتماماً للفائدة كانت هذه الدِّراسة دراسة موازنة ببعض التَّشريعات وخصوصاً القانون المدني المصري والقانون المدني العراقي ومجلَّة الأحكام العدليَّة، وذلك لأنَّ هذه التَّشريعات الثَّلاثة تُعدُّ المصدر التَّاريخي لمعظم نصوص القانون المدني الأردني، فضلاً عن ذلك فإنَّ أحكام المجلَّة الَّتي لا تتعارض مع أحكام هذا القانون ما زالت مطبَّقة في الأردن وتُعدُّ جزءاً لا يتجزَّأ من القانون المدني الأردني؛ كما تضمن هذا الكتاب عرضاً وتحليلاً للكثير من قرارات محكمة التَّمييز الَّتي تُمثّل موقف القضاء الأردني.
