النشاط القضائي يتجسد في الواقع العملي من خلال شكلين أساسيين: شكل الحكم وشكل الامر، ورغم انهما يمثلان الإطار او الشكل الخارجي الذي يمارس فيه القاضي وظيفته في منح الحماية القضائية، الا ان المشروع وضع لكل منهما منهجا اجرائيا ونظاما متميزا يتناسب مع دوره في الحياة القانونية. ومن ناحية اخرى :فإن هذه الاحكام والأوامر لا تؤدي دورها كاملا في منح الحماية القضائية الا اذا روجعت بمعرفة سلطة اعلى من سلطة القاضي الذي اصدرها من خلال طرق الطعن التى قررها القانون ، تأكيدا لما قررته من حقوق واعمالا لمبدأ التقاضي على درجتبن كأحد المبادئ الاساسية لحق التقاضي. وترتيبا على ما سبق ، سوف تنقسم دراستنا في هذا القسم إلى ثلاثة ابواب الباب الاول : الأحكام الباب الثاني : الأوامر الباب الثالث: طرق الطعن
