يعد قيام الثورة الفرنسية وتغير مفهوم السيادة أصبح بالإمكان مساءلة الدولة عن أعمال الإدارة ثم توسع نطاق مسؤوليتها تدريجياً حتى امتد إلى أعمالها التشريعية، إلاّ أنّ أعمال السلطة القضائية ظلت بمنأى عن المسؤولية، لما للقضاء من مكانة متميزة، فهو يُمثل بحق رمز سيادتها ورمز سلطتها، فضلاً عن وجود إعتبارات أخرى تقف عائقاً أمام تقرير مسؤولية الدولة عن أعمال السلطة القضائية منها إستقلال السلطة القضائية عن الحكومة وسيادة القضاء ومبدأ حجية الأحكام وعدم عرقلة سير العدالة وغيرها.
إلا أن المشرع الفرنسي تدخل لاحقاً - تحت ضغوطات حقوق الإنسان وإرتفاع نداءات الفقهاء - لتنظيم بعض المسؤوليات في بعض الحالات الخاصة (إستثناء)، كما بادر القضاء الفرنسي من جانبه إلى تقرير مسؤولية الدولة عن أعمال مرفق القضاء في بعض الحالات خارج إطار النصوص التشريعية، إلى أنّ تدخل المشرع الفرنسي في عام 1972 إذ قرر مسؤولية الدولة عن أعمال السلطة القضائية، لتكون القاعدة هي المسؤولية ويصبح الإستثناء منها هو عدم المسؤولية، ومع ما تقدم وقف المشرعان المصري والعراقي مكتوفي الأيدي أمام هذا التطور المهم في مجال المسؤولية، ورفضاً التخلي عن المبدأ التقليدي والإكتفاء بالنظام التقليدي لمخاصمة القُضاة الذي يحكم مسؤولية القُضاة مدنياً عن أخطائهم الشخصية.
