ويصبح العنف أكثر فتكاً عندما يمارس باسم القانون، وهو ما نعني به العنف القانوني: فالعنف القانوني يعـزز ثقافة التسلط والاقصاء داخـل الأسرة ويؤثر علـى تنشئة جيل على قيم غير ديمقراطية تنتهك حقوق الانسان، مما يشكل ضرراً لا يجوز التغاضي عنه أو التسامح معه.
إن ظاهرة العنف تستدعي العلاج، وقد ثبت بالتجربة أن العنف ليس قدراً محتوماً بل مرضاً قابلاً للعلاج إذا ما استعملت الوسائل العلمية الفعالة لمعالجته، وإذا ما استخدمت الآليات القانونية المناسبة للوقاية منه ولحماية ضحاياه ومعاقبة مرتكبيه.
إن القوانين اللبنانية المعمول بها حالياً في لبنان، وبشكل خاص قوانين الأحوال الشخصية وقانون العقوبات، هي قاصرة عن معالجة هذه الظاهرة لأنها تشكل بحد ذاتها حالة عنف: بعض القواعد القانونية عنيفة بحق النساء وظالمة لهن، وبعضها الآخر يجيز بعض الممارسات العنفية ويتساهل مع مرتكبيها...
ولما كان موضوع تجريم العنف المنزلي ومعاقبة مرتكبيه وحماية النساء منه ومعالجة أسبابه يبدأ بتنزيه القوانين من العنف ومراجعتها على ضوء القيم التي يحميها الدستور ومبادئ العدالة والمساواة التي تؤسس لمجتمع ديمقراطي حقيقي، مما حدا بنا في الدراسات المعروضة في هذا الكتاب إلى تسليط الضوء على مواضع العنف ضد المرأة في قوانين الأحوال الشخصية وقانون العقوبات وصولاً إلى إقتراح الحلول الفورية الوقائية والرادعة لحماية المرأة من العنف المنزلي.
