تعتبر ظاهرة اللجوء من أقدم الظواهر البشرية، بإعتبارها ظاهرة ملازمة للإضطهاد فحيثما وجد الإضطهاد والإستبداد وجد اللجوء، فما من حضارة إلا وعَرف أهلها الإنتقال من مكان إلى آخر خوفاً من الإضطهاد وبحثاً عن مكان آمن للإبتعاد عن الخطر الذي يهددهم.
فيمكن إعتبار مشكلة اللجوء واللاجئين من المواضيع المستمرة والثابتة إذا صح القول، حيث أن أعداد اللاجئين أصبحت في إزدياد يوماً بعد يوم، ومشكلة اللجوء أصبحت معضلة يواجهها المجتمع الدولي، ففي هذا العصر إزداد وبشكل ملحوظ وقوع العديد من الإشتباكات المسلحة، سواء تلك التي وقعت بين دولتين أو أكثر (الحروب) أو تلك التي تمثل حرباً أهلية أو تتمثل في زعزَعَت الأمن الداخلي أو بسبب الإنتهاكات لحقوق الإنسان المتمثلة بملاحقة الشخص في بلده الأم بسبب عرقه أو قوميته أو دينه أو آرائه السياسية أو تبعيته لفئة إجتماعية معينة، فما دام هناك إنكار لحقوق الأفراد والجماعات والشعوب، وما دامت الخلافات مشتعلة، وما دامت هنالك أنظمة تحكم شعوبها بالحديد والنار، وما دامت بؤرة صراع السلطة بأتساع فإن ظاهرة اللجوء مستمرة ولن تنتهي.
ولأهمية هذا الموضوع ولقلة ما كتب عنه من كتابات بحثية متخصصة وإيماناً من المؤلف بغزارة الجوانب الإنسانية لهذا الموضوع والقيم الحضارية الذي قد تجعل جوانبه الإنسانية تسمو على الكثير من المواضيع الأخرى في عصرنا الحاضر، اخترت هذا الموضوع للكتابة فيه ومعالجة الجوانب المتعلقة بالمركز القانوني لطالب اللجوء وإجراءات تحديد مركز اللاجئ التي يمكن تعريفها على إنها الاصول المتبعة من قبل الجهة صاحبة الإختصاص منذ لحظة تقديم طلب اللجوء وحتى الوصول إلى لحظة القرار حول الطلب والسبب في ذلك أن الدول لم تتبع سياسة واحدة في تعريف اللاجئ فطالب اللجوء الذي يتم الإعتراف به في دولة معينة قد لا يتم الإعتراف له بهذه الصفة في دولة أخرى، وهذا بسبب ترك وضع الإجراءات بيد الدولة دون التحديد بشكل واضح.
