Book Description
يعتبر كتاب الخصال: نتيجة ما توجه إليه القصد، وانتهى إليه الجهد، عند ابن زرب. وقد ضمنه حصيلته الفقهية، واجتهاداته القضائية. فجاء جامعاً لضروب الجودة، مستوفياً لأسباب القبول.
حيث يتقوم العمل فيه بالحديث عن معنى الخصال، وسبب تأليفه، وموقعه من كتب الخصال الأخرى.
وفي اللغة يأتي معنى الخصال: وهو جمع مفرده خصلة، تطلق في اللسان، وتراد بها معان منها: "الفضيلة والرذيلة تكون في الإنسان، إلا أن دلالته على الفضيلة أعلى".
أما إستعمال الخصال بمعنى الحكم الشرعي، فقد جاءت بمعنى الحكم، من حيث حجيته ومستنده.
ووردت الخصال بمعنى الواجب الذي يجبر بالدم، كقوله: "خصائص إذا تركها المحرم تم حجه، وعليه الدم، وبمعنى المفسد، وبمعنى الموجب.
وبالعودة إلى متن الكتاب تعتبر الفترة التي ألف فيها الخصال: مرحلة فاصلة بين عصر الأمهات المطولات، والشروح والتقييدات. لذا جاز أن تنعت طبقة أبن زرب بخاتمة المتقدمين لأنهم كانوا ينقلون عن مالك بالواسطتين والثلاثة.
وهنا عرض موضوعات الخصال كما وردت في تراجمها الكلية، المنظمة في كتبها الفقهية. وقد بلغ مجموع الكتب التي ضمنها ابن زرب مؤلفه الخصال: نحو ستين كتابا فقهياً، أقدمها مرتبة كما هي عند صاحبها: الطهارة، والصلاة، والزكاة، والصيام، والإعتكاف، والحج، والجهاد، والجنائز، والضحايا، والذبائح، والصيد، والإيمان، والنذور، والأشربة، والإجازة، والجعل، والرواحل والدواب، وكراء الدور، والسلم، والنكاح، والطلاق، والتخيير، والتمليك، وإرخاء الدستور، والظهار، واللعان، والرضاع، والمواريث، والعتق، والتدبير، والمكاتب، وأمهات الأولاد، والولاء، والوصايا، والقضاء، والشهادات، والحبس والهبة والصدقة، والعارية، والوديعة، والعرايا، والرهون، والشركة، والقراض، والوكالات، والإستحقاق، والقسمة، والشفعة، والصلح، والمديان، والتفليس، وتضمين الصناع، واللقطة، وحريم الآبار، والجوائح، والمزارعة، والمغارسة، والغضب، والسرقة، والمحاربين، والحدود، والديات.
