لم يحظ موضوع "وقف عقد العمل" بالإهتمام الكافي من الفقهاء العرب عموماً والعراقيين خصوصاً على الرغم من مساسه بالإلتزامات المادية الرئيسة لطرفي العلاقة، واكتفى فقهاء قانون العمل بإحالته في كتاباتهم إلى المبادئ العامة لنظرية وقف العقود المدنية، على الرغم من الحاجة إلى رسم الحدود الفاصلة بين كل من النظريتين.
ولأن نظرية "وقف عقد العمل" قد استمدت أحكامها من نظرية "وقف العقود" والتي أنشأها القضاء المدني الفرنسي ونتيجة من ترسخ أحكامها وتطبيقاتها في القانون والقضاء الفرنسي فكان من الضروري دراسة القانون الفرنسي، كما أن القانون المصري والذي استمد أحكامه من القانون الفرنسي على مر التاريخ يعد أكثر القوانين العربية المتطورة.
ولذلك كان للمؤلف فيه وقفة مقارنة، ولعدم القدرة على إستيعاب البحث كافة التشريعات المنظمة لعلاقة العمل على المستويين العالمي والعربي قام المؤلف بدراسة قانون العمل العراقي رقم (71) لسنة 1987 وقوانين العمل العراقية الثلاثة الأخرى (قانون العمل رقم (72) لسنة 1936 وقانون العمل رقم (1) لسنة 1958 وقانون العمل رقم (151) لسنة 1970) ومقارنتها مع قوانين العمل المصرية والفرنسية.
ولمعالجة موضوع "وقف عقد العمل" ارتأى تقسيم الموضوع إلى مبحث تمهيدي لتحديد مفهوم "وقف عقد العمل" وتمييز المفهوم العائد لقانون العمل عن المفهوم الخاص بالقانون المدني كما تميز مفهوم "عقد العمل" عن بعض المصطلحات التي تختلط به.
وفضلاً عن ذلك تضمن البحث ثلاثة فصول تناول الفصل الأول شروط وقف عقد العمل وتعرض الفصل الثاني لحالات وقف عقد العمل العائدة إلى إتفاق طرفي العقد أو إلى العامل أو صاحب العمل أو نزاعات جماعية "إضراب وإغلاق"، وانصرف الفصل الثالث لبحث آثار "وقف عقد العمل" على طرفي العقد سواء كانت مباشرة أو غير مباشرة، فضلاً عن أثر "وقف عقد العمل" على الغير من المتعاقد معهم.
وأخيراً الخاتمة والتي تضمنت عرضاً سريعاً للنتائج التي توصل إليها البحث في هذا الموضوع وتوصيات المؤلف لهذه الخصوص.
