يرتكز الالتزام العقدي في الفقه الحاضر - سواء في نشأته أو في بيان مضمونه - على الإرادة، بمعنى أن إرادة المتعاقد التي ساهمت في إبرام العقد هي أساس تولد الالتزام في حقه، كما هي مناط تحديد مداه. ويرتد هذا النظر إلى ما يقول به مذهب سلطان الإرادة الفردية من أن كل شخص يتمتع في الأصل بحق طبيعي ومطلق في الحرية، ومن ثم لا يجوز تقييد هذه الحرية بأي قيد إلا إذا كان نابعاً من رضاء الشخص نفسه. فالإرادة هي التي تضع القانون الذي تخضع له، وهي التي تخلق الالتزام في ذمتها بمقتضى نفس سلطانها ومشيئتها.
ويتناول القسم الأول من الرسالة نقداً تفصيلياً لمذهب الإرادة بعد أن نمهد له ببيان عن نشأة هذا المذهب ونتائجه. ونخصص القسم الثاني لعرض محاولتنا الكشف عن الأساس الصحيح للالتزام العقدي وما تؤدي إليه هذه المحاولة من نتائج.
