يُعتبر الإسلام نظام شامل ومتكامل للحياة، فهو ليس ديناً تعبدياً فقط، بل إن فيه من الضوابط الكلية والقواعد الفقهية ما ينظم أمور الناس، ومن الأمور التي نظمها الفقه الإسلامي ووضع لها أحكاماً وضوابط: "الصناعات" التي هي عماد المجتمع وركيزته الأساسية.
وهذا الكتاب يتحدث عن القيود التي وضعها الفقه الإسلامي على الحرية في مجال الصناعة، ويشتمل على مقدمة وفصل تمهيدي وبابين وخاتمة:
فالمقدمة: تشتمل على أهمية الموضوع ومنهج البحث.
والفصل التمهيدي: يشتمل على عناصر الموضوع والتعريف به والحكم الشرعي للعمل بالصناعة، ومنزلة الصناعة من سائر الحرف، وأقسام الصناعات والحرف.
وأما الباب الأول: فيتحدث عن الملامح والصور التي تظهر فيها حرية الصناعة، ومنها بيان حرية الإحتراف وشروط الحرفة عند الفقهاء، وكذلك حرية المنافسة وحكمها.
أما الباب الثاني: فيتحدث عن أنماط الصناعة والقيود الواردة على الحرية فيها، ويشتمل على فصول ستة: الفصل الأول: يتحدث حول القيود التي تهدف إلى حماية الصحة. أما الفصل الثاني: فيتحدث عن القيود التي تهدف إلى حماية العقيدة. أما الفصل الثالث: فجاء للحديث عن القيود التي تهدف إلى منع الرذيلة ومحاربة الترف. وأما الفصل الرابع: ففي بيان القيود التي تهدف إلى الحفاظ على أمن وسلامة المجتمع. أما الفصل الخامس فجاء للحديث عن حماية المستهلك ومنها بيان تحريم الغش والتغرير. أما الفصل السادس والأخير: فيتحدث عن القيود التي يضعها ولي الأمر بهدف المصلحة العامة، واشتمل على بيان حكم فرض ضرائب على الصناع، وعن تحديد أماكن المصانع، وصدور الترخيض لها، وعن حكم استئثار الدولة بصناعات معينة ومنع الأفراد من مزاولتها. ثم الخاتمة التي احتوت على ستة وعشرون بنداً وهي إستنتاجات الباحث واقتراحاته فيما يخص موضوع البحث وأهمها الدور العظيم الذي قام به فقهاؤنا الأوائل – رضوان الله عليهم – من محاولة لوضع حلول لكل قضية، بما ينفع البشر وبيان سبيل الحق وتوضيحه للناس ...
