لماذا هذا الكتاب؟ ... لقد ظل الدرس الفقهي حُرَّاً، تسري الحياة في أوصاله ما بقي مستقلاً عن السلطة السياسية، بل إنه ظهر، في بعض مراحل التاريخ الإسلامي، بوصفه قوةً شعبية تدفع جور السلطان، وتقف الناس على الحقيقة حين تسعى إلى طمسها حيلٌ السياسة وأهواءُ الساسة، ولما آل أمره إلى الدولة ذهبت عنه، شيئاً فشيئاً، نضارة ذلك الوجه القشيب، واستحال التنوع المذهبي مع الأيام مذهباً واحداً، بل رأياً واحداً من الآراء التي ينطوي عليها ذلك المذه، فلا يحل لمفتي الدولة الحيدةُ عنه في فتاواهم، ولا لقضاتها العدولُ عنه في أقضيتهم، واستوجب ذلك إنشاء نمط من التعليم الفقهي الموحد "المدعوم من السلطة السياسية" ليخرّج المفتين والقضاة العالمين بهذا "المختار السلطاني"، العاملين به فيما يأتون وما يدعون، فتوحد النظام القضائين غير أنه أثمر قضاة يعتقدون في أنفسهم أنهم "لا يفرقون بين الغث والسمين، ولا يميزون الشمال من اليمين"، وغلب على فقهاء ذلك العصر.
في الجملة، إحساس "بالقصور" العلمي بالنظر إلى الفقهاء المتقدمين، فأورثهم ذلك عزوفاً "إرادياً" أول الأمر، ثم "تلقائياً"، بعد ذلك، عن الإجتهاد، ولو مذهبياً، ولا أدل على ذلك من المقارنة بين "القاضي" كما صوره الماوردي و"القاضي" في العصر العثماني، فإنها تُجمل ، في رأيي، الإختلاف بين وضعين حضاريين، لا بين نظامين قضائيين فحسب.
