أن سبب إختيار موضوع الباحث وأثره في جريمة القتل العمد هو لأهميته وتشعب مصادره ولما يتميز به من طابع تطبيقي، وصفه عملية بإعتباره عذراً قانونياً نص عليه المشرع، وكذلك يمثل دافعاً عاماً لإرتكاب أية جريمة ومنها جريمة القتل العمد، ولما له من علاقة وطيدة بالمجتمع متمثلاً بالأخلاق والقيم النبيلة التي تتعلق بالسلوك الشخصي النابع من خصال أو عادات المجتمع السائدة التي لها تأثير على نمط الحياة.
وليكون الموضوع حاضراً في ذهن القارئ وخالياً من الإسهاب والتكرار وقاصراً على العبارات العلمية وحدها، عمدت إلى عرضه وفق خطة قسمتها إلى أربعة فصول، يتضمن الفصل الأول ستة مباحث الأول: ماهية الباعث في جريمة القتل من حيث تعريفه لغةً وفقهاً وإصطلاحاً وقانوناً، والثاني: إثبات الباعث ودوافعه، والثالث: مدى إعتبار الباعث ركناً في جريمة القتل، والرابع: الأهمية القانونية للباعث والغاية، أما الخامس: فالأعذار والظروف القضائية ومدى تأثرها بالباعث، والسادس: الحالات التي تؤثر في تحديد وتصنيف الباعث.
أما الفصل الثاني: فقد تناولت فيه تمييز الباعث عن غيره من الأوضاع القانونية المشابهة، إما الفصل الثالث فتضمن مبحثين، المبحث الأول: تصنيف البواعث من حيث طبيعتها، إما المبحث الثاني: تصنيف الباعث من حيث الوصف وقسم إلى خمسة مطالب، إما في الفصل الرابع فتناولت فيه: أثر الباعث في عقوبة جريمة القتل العمد، وقد ختم هذه الدراسة بمجموعة من النتائج والتوصيات التي تم التوصل إليها.
