بحثنا في هذه الدراسة موضوع مشكلات التعاقد عبر الإنترنت، وهو على جانب كبير من الأهمية في المعاملات، والحياة القانونية لكل من الأشخاص الطبيعية، والإعتبارية، وجميع الدول التي تسعى لمواكبة التطور العلمي المستمر، بتحديث تشريعاتها القانونية، لتتلائم مع عصر جديد هو عصر التكنولوجيا الإلكترونية، بما يخدم التقدم الإقتصادي، والإجتماعي بين مواطنيها.
ونتيجة لظهور هذا النوع الحديث من التعاقد، بإيجابياته، وسلبياته، بدأت الدول بمواجهته من خلال التعديل في قوانينها التقليدية، كالقانون المدني، وقانون الإثبات، وقانون المرافعات من جهة أولى، وبإصدار مشروعات، وقوانين المعاملات الإلكترونية من جهة أخرى، للتخفيف من حدة أو خطورة المشكلات الناتجة عن هذا النوع من التعاقد، بهدف القضاء عليها، والوصول إلى أنسب الحلول بشأنها.
وعملنا على بحث مشكلات التعاقد عبر الإنترنت في القانون المصري، مع المقارنة بالقانون الأردني، والسوري، والإماراتي، والكويتي، والإنجليزي، وأحدث تعديلات القانون المدني الفرنسي، وذلك في قسمين، يسقهما فصل تمهيدي، خصصناه لشبكة الإنترنت، مفهومها، أهميتها، تمييزها.
وفي القسم الأول عالجنا ماهية التعاقد عبر الإنترنت، أما القسم الثاني من الرسالة فخصص لآثار التعاقد عبر الإنترنت.
