في هذه الدراسة سوف نتناول موضوع "التعاقد عبر الانترنت" حيث أن شبكة الإنترنت هي أحدث وسيلة لإبرام العقود، فالتعاقد عبر الإنترنت أصبح، من الأمور المنتشرة في المجتمع نتيجة لسهولة وسرعة هذه الطريقة من طرق التعاقد والتي لا تقضي سوى الدخول علي موقع علي الشبكة أو القيام بإرسال رسالة إلكترونية، وذلك دون أن يتحرك المتعاقد من مكانة بالمنزل أو بالعمل.
التعاقد عبر الأنترنت هو أحدث صور التعاقد على الإطلاق، هذه الصورة الحديثة ستؤثر في نظرية العقد في القانون المدني، بحيث إنه يجب البحث في مدى قدرة القواعد الموجودة في هذه النظرية على الانطباق علي هذه الصورة الحديثة، أم أن الأمر يقتضي إضافة قةاعد جديدة لهذه النظرية بحيث تتسع لمثل هذه الصورة الحديثة من صور التعاقد.
كما أن قواعد الإثبات التقليدية المعتمدة علي المحرر الورقي يمكن أن تقف حائلا أمام منح الثقة لمثل هذا التعاقد الذي يتم بدون وجود محرر ورقي أو توقيع تقليدي، الأمر الذي يقتضي تعديل هذه القواعد حتى تصبح قادرة على منح هذه الثقة المفقودة أو إضافة قواعد حديثة تتواءم مع المحرر الإلكتروني والتوقيع الإلكتروني.
