إن دراسة غاية القانون تعد مطلباً لا يمكن التغاطي عنه، فالقانون بلا غاية يعد مجرد أمر واقع ينقصه المشروعية. إن غاية القانون حي في ذات الوقت "القوة الخالقة" له، وحدوده التي توضح كيفية "تفسيره" و"طريقة تطبيقه". إن غاية القانون هي القوة الواقعة التي تدعو القانون بإلحاح إلى أن يتسامى على نفسه ويصبح أكثر وفاء بحاجات المجتمع، ويخضعه في ذات الوقت للقانون الطبيعي أي للمثالية القانونية، ولمتطلبات التقدم، ويخلصه من الطقوس العتيقة التي تعوق حركته ومرونته، إنه ضميره القلق، ورأسه المفكرةى... وكل ما لا ينسجم معه من قواعد ونصوص يجب استبعاده من نطاق القانون. ومجمل القول إذن أن معرفة الغاية التي يرمي القانون إلى تحقيقها يؤدي إلى حسن فهم القانون وإدراكه. كما يؤدي أيضاً إلى دقة تفسيره وملائمة تطبيقه. فإذ أخذنا مثلاً بمذهب الوضيعية الإرادية، والذي يرى أن القانون ما هو إلا تعبيراً عن إرادة المشرع، أمكن تفسير القانون بالهدف أو الغاية التي توخى المشرع إدراكها من النص. وتكمن أهمية هذا الكتاب الذي بين يدينا في أنه يقدم دراسة موسعة تلقي الضوء على فلسفة القانون وغايته. وفيها يعرض المؤلف أولاً للغاية القريبة أو الفنية للقانون وبعد ذلك نظرة شاملة للغاية المتالية للقانون وللقيم كفاية للقانون، وفي آخر الكتاب يقدم دراسة تطبيقية عن غاية القانون في النظام القانوني المصري متخذاً الفتح الإسلامي بداية لتوقيت الدراسة.
