إن الحمد لله نحمده ونستعينه ونستغفره ونعوذ بالله من شرور أنفسنا ومن سيئات أعمالنا من يهده الله فلا مضل له ومن يضلل فلا هادي له وأشهد أن لا إله إلا الله وحده لا شريك له وأشهد أن محمداً عبده ورسوله صلى الله عليه وسلم وبعد فإن الأحكام الشرعية كثيرة ومتنوعة، مبثوثة ومنشورة في الكتب الفقهية بل قد تكون موجودة في غير مكانها ومذكورة في غير أبوابها، فالكتب الفقهية تتفاوت في استيعابها للموضوعات والأحكام، وتتفاوت في نقلها وأسلوبها وتشعب الآراء المذهبية فيها. وفي هذا العصر فإن الحاجة ماسة إلى الكثير من الدراسات الإسلامية الواعية الجادة حول قضايا معاصرة تستحوذ على اهتمام الرأي واهتمام الناس كافة، ومعلوم أن المملكة العربية السعودية تشهد منذ سنوات ليست بالقصيرة تقدماً في مجال التعليم وسن الأنظمة قد تولد عنه بفضل الله العديد من الإنجازات مما يدل على أننا مقبلون على تغييرات جذرية سوف تتطلب سرعة اتخاذ القرارات الكفيلة بعدم الخروج من دائرة الشريعة الإسلامية، ومن هذه الأنظمة التي ظهرت على الساحة نظام المحاماة الذي يتوقع له أن يقوم بدور إيجابي مثمر في النهوض بمهنة المحاماة والعناية بشؤون المحامين في البلاد وحيث أن هذا النظام حديث النشأة ويحتاج إلى دراسة وإلى فهم عميق أحببت أن أكتب في هذا الموضوع وأن أقدم خطة بحث تكميلي لنيل درجة الماجستير.
