من منطلق أن منع وقوع العدون خير من صد العدوان، وأن الضربة الأولى هي الضربة القاضية كما يقول العسكريون، فإن الدول البادئة بالهجوم قد اتخذت من تلك المبررات ذريعة لها لتبرير أفعالها والقول بضرورة وجود دفاع شرعي وقائي، لأن منع وقوع العدوان يعتبر ضرورة لإقرار السلم والأمن الدولي، لأن البدء بالضربة الوقائية من شأنه أن يحرم المعتدي من فرصة القيام بعدوانه، والقول بتحريم الضربة الوقائية، أو الهجوم الوقائي من شانه أن يؤدي بالضرورة إلى أن تترك الفرصة للمعتدي لكي يبدأ بالعدوان، ويكون له سبق توجيه الضربة الأولى والتي تعد نصف الانتصار.
تأتي تلك الدراسة في هذا الكتاب على النحو الذي يحقق التوضيح الكامل لكافة أرجاء وعناصر حق الدفاع الشرعي الوقائي، وهي الناحية التطبيقية التي ندرس من خلالها بعض صور استعمال هذا الحق والممارسات الدولية التي أثير بصددها حق الدفاع الشرعي الوقائي في عالمنا المعاصر، وبعد التطور القانوني الذي لحق بالقواعد القانونية والتي سايرت بذلك إيقاع الحياة السريع الذي نعيشه، وبعد التطور الهائل في وسائل الحروب والأسلحة الالكترونية والنووية وغيرها الكثير نجد تزرع بعض الدول بأسباب واهية للرجوع للتدخل في شئون غيرها وشن الحرب عليها وإعادة الكرة من أولها.
