من منطلق ان منع وقوع العدون خير من صد العدوان ، وأن الضربة الأولى هى الضربة القاضية كما يقول العسكريون ، فإن الدول البادئة بالهجوم قد اتخذت من تلك المبررات ذريعة لها لتبرير أفعالها والقول بضرورة وجود دفاع شرعى وقائى ، لأن منع وقوع العدوان يعتبر ضرورة لإقرار السلم والأمن الدولى ، لأن البدء بالضربة الوقائية من شأنه أن يحرم المعتدى من فرصة القيام بعدوانه ، والقول بتحريم الضربة الوقائية ، أو الهجوم الوقائى من شانه أن يؤدى بالضرورة إلى أن تترك الفرصة للمعتدى لكى يبدأ بالعدوان ، ويكون له سبق توجيه الضربة الأولى والتى تعد نصف الانتصار . تأتى تلك الدراسة فى هذا الكتاب على النحو الذى يحقق التوضيح الكامل لكافة أرجاء وعناصر حق الدفاع الشرعى الوقائى ، وهى الناحية التطبيقية التى ندرس من خلالها بعض صور استعمال هذا الحق والممارسات الدولية التى أثير بصددها حق الدفاع الشرعى الوقائى فى عالمنا المعاصر ، وبعد التطور القانونى الذى لحق بالقواعد القانونية والتى سايرت بذلك إيقاع الحياة السريع الذى نعيشه ، وبعد التطور الهائل فى وسائل الحروب والأسلحة الإليكترونية والنووية وغيرها الكثير نجد تزرع بعض الدول بأسباب واهية للرجوع للتدخل فى شئون غيرها وشن الحرب عليها و إعادة الكرة من أولها .
