إن فكرة الدفاع الشرعي الوقائي هي من الأفكار محل الخلاف في مجال القانون الدولي المعاصر، وإن كانت من المبادئ والأفكار الأصيلة في مجال القانون الدولي العرفي، التي لم يتوافق عليها أفراد المجتمع الدولي، والتي ما زالت محل بحث ونقاش من جانب الدول، وذلك عادة كل فكرة جديدة، فالناس تستهجن كل حديث وتظل على الخال حتى تتعوده وتتأقلم عليه، وهنا يصبح شيئًا عاديًا ومقبولًا لديهم، وبالتالي يطبقونه ويلتزمون قواعده وأحكامه.
حيث يتمثل الطابع الأساسي في الدفاع الشرعي الوقائي ويتسم بالحرية المطلقة من أي قيد، الذي يخول الدولة العمل بالمخالفة لأية قاعدة من قواعد القانون الدولي، ومن ثم الإخلال بأي حق من حقوق الدول الأخرى، وذلك متى قدرت تلك الدولة أن ذلك العمل من اللازم اتخاذه من أجل المحافظة على نفسها، وحتى ولو لم تكن الدولة الأخرى التي تستخدم القوة ضدها والمعتدى عليها قد أخلت بحقوق الدولة الأولى، أو اقترفت أي مخالفة قانونية بحقها، حتى يمكن تبرير ممارسة الدفاع الشرعي الوقائي.
يتعرض هذا الكتاب للعديد من الموضوعات التي قامت فيها المؤلفة بدمج الكثير والكثير من الأوراق وتحرت من خلالها الدقة والالتزام بالحياد والموضوعية في المعالجة دون أي تحيزات مسبقة علاوة على تلمس الأمانة العلمية في السرد والتنقيح حيت تناولت الفصول كلًا من حق الدفاع الشرعي في القانون الدولي العام، محاولة وضع تعريف للدفاع الشرعي عن النفس، حق الدفاع الشرعي الوقائي في النظم القانونية المختلفة.
