نتيجة للتطور الثقافي الذي شهدته الإنسانية استحدثت مصطلحات تضم بين ثناياها مفردات مشتتة بالرغم من وجود رابطة معينة تجمعها بتصنيف معين، ومن بين تلك المصطلحات مصطلح (الممتلكات الثقافية) والذي جمع بين ما أنتجه الإنسان من آثار ثابتة ومنقولة وما أبدعته الجماعات من تراث مادي وغير مادي وما أحدثته الطبيعة من أشكال أو حافظت على هيئته كمتحجر الحيوان والنبات. ولكل منها أهمية كبيرة في دراسة ماضي الإنسان وتأثيره على الطبيعة وتأثره بها، والوصول إلى أصل الحضارات وتطورها لاستقراء ما يمكن أن يصل إليه الإنسان غداً. إن الحل الوحيد لحماية الممتلكات الثقافية يأتي بتضافر جهود المجتمع الدولي من خلال القانون الدولي، لذا فالبحث في الحماية القانونية الدولية لها يأخذ أهمية كبيرة في الوقوف على التطور الحاصل في مفهوم الممتلكات الثقافية وترسيخ العرف الدولي الذي قد يفضي إلى تقنين دولي قادراً على ىتحقيق الحماية الكاملة فاتحاً آفاق المعرفة والإحترام والفهم الحقيقي لها في الوسط الإنساني من عالمنا المعاصر.
