مهنة المحاماة هي إحدى المهن الحرة المنظمة بقانون، أي أن القانون أنشأ لها نقابة ينتظم فيها المحامون وهي التي ترعى شؤونهم إنطلاقاً من تحديد الشروط اللازمة لاكتساب صفة المحامي ... وقد صدر أول قانون لتنظيم مهنة المحاماة، في لبنان، بتاريخ 6/2/1919م بمقتضى قرار الحاكم الإداري العام رقم 192. ثم طرأت عليه تعديلات كان آخرها القانون رقم 8/70 الذي اشترط ومن بعده جميع القوانين (على من يريد ممارسة المهنة أن يكون من حاملي شهادة الحقوق).
وبالنظر لارتباط مهنة المحامة بالقضاء، وبالنظر للتطور المستمر لقانون تنظيم مهنة المحاماة، ولأن تلك النصوص لا تبدو كافية لحل المسائل المتعلقة بوكالة المحامي أو بتنظيم مهنته، وما رتبته قوانين ممارسة المهنة من علاقة بين المحامي ونقابته، وكذلك تشعب العلاقة بين المحامي وموكله، يضع المؤلف دراسة شاملة عن (المحامي بين القضاء والنقابة والموكل) إنطلاقاً من تجربته العملية في تلك المهنة، وذلك بترؤسه لمحكمة الإستئناف في بيروت التي تنظر في استئناف القرارات الصادرة عن أجهزة النقابة فضلاً عن دورها في النظر بدعاوى أتعاب المحاماة، كل تلك الممارسات خلقت إشكالات في علاقة المحامي بالقضاء، وبالنقابة، وبالموكل فكان لا بد من بحثها من وجهة نظر كل جهة، وهو ما يتناوله المؤلف في هذا الكتاب.
