Book Description
الإذن الطبي ينقسم إلى صريح، وشبه صريح، وغير صريح.
السكوت لا يكون إذنًا في الإجراء الطبي.
الإذن الطبي يكون شفويًّا وكتابيًّا.
إذا كان المريض أهلًا فإنه لا يحق لأحد أن يعترض على إذنه، ولا أن يأذن عنه.
يشترط للإذن الطبي ستة شروط: 1- أن يصدر ممن له الحق. 2- أن تتحقق أهلية الآذن. 3- أن يكون المأذون به مشروعًا. 4- أن يكون الإذن محددًا. 5- أن يكون الإذن بلفظ صريح أو شبهه. 6- أن يستمر الإذن حتى ينتهي الإجراء الطبي.
للمريض أن يمتنع عن الإذن بالإجراء الطبي في حالة الضرورة وعدمها.
يجوز النشر في الكتب العلمية عن حالة المريض وأعراض مرضه دون إذن منه، إذا لم يكن في النشر إشارة إلى اسمه أو صورة له.
جواز نقل الأعضاء الآدمية التي لا يفضي نقلها إلى موت المتبرع متى أذن بذلك.
لا يجوز قطع عضو من الإنسان إلا لغرض شرعي، كالتداوي.
الطبيب إذا لم يؤذن له صار ضامنًا لكل ما يحصل نتيجة عمله.
إذا امتنع المريض عن الإذن فلم يعالج فمات، فليس قاتلًا لنفسه.
المتطبب الجاهل ضامن.
