منى الإسلام وأهله منذ نشأته بالإختلاط بطوائف تخالفه في العقيدة وظل هذا شأنه في عصوره المختلفة، وبلاده المترامية الأطراف، وكان حتماً أن تتصل تلك الطوائف بالمسلمين فتنشأ بينهم علاقات ومعاملات شتى، تشتد الحاجة إلى معرفة حكمها، والوقوف على رأي الشريعة الإسلامية فيها.
من هنا، جاءت فكرة هذا الكتاب الذين يبحث عن أحكام تلك العلاقات، ويقارنها بين الشريعة الإسلامية، واليهودية والمسيحية والقانون، لينتفع بها راغب العلم، ويصل بالطالب إلى بغيته، وبالعالم إلى ضالته، من غير تنقيب في بطون الكتب.
وقد اشتمل الكتاب على مقدمة، وخمسة أبواب، وخاتمة، أما المقدمة فتناول المؤلف فيها معنى إختلاف الدين، وموقف الإسلام من غير المسلمين في التشريع، وأما الباب الأول ففي علاقة المسلم بغير المسلم في العقود، وأما الباب الثاني ففي علاقة المسلم بغير المسلم في عقود غير المعاوضات، وأما الباب الثالث: ففي علاقة المسلم بغير المسلم في الولايات، وأما الباب الرابع ففي علاقة المسلم بغير المسلم في الجنايات والحدود، وأما الباب الخامس: ففي علاقة المسلم بغير المسلم في الذبائح، واشتملت الخاتمة على موقف غير المسلمين من المسلمين في العصور الأخيرة.
