وإذا كنا نتناول موضوع التحكيم التجاري الدولي والداخلي في قانونه الجديد تشريعاً وفقهاً وقضاءً وحتى يكون في متناول القاضي والمتقاضى مصرياً كان أم أجنبياً تاجراً أم مستثمراً أم مرتبطاً بعلاقة مدنية فإنه لا يفوتنا أن نشير إلى أهمية الأعمال التحضيرية لهذا القانون فهي ذات قيمة كبيرة في تعرف نية المشروع ليس بالنسبة إلى ما نص عليه فحسب بل أيضاً بالنسبة إلي ما لم ينص عليه.
فقد رأينا أن نعرض لكل نص مقارناً بالنص الملغى من قواعد التحكيم الملغاه في قانون المرافعات, ثم مشروع القانون كما ورد من الحكومة مقارناً به كما عدلته اللجنة المشتركة من لجنة الشئون الدستورية والتشريعية ومكتب لجنة الشئون الاقتصادية بمجلس الشعب والمذكرة الايضاحية, وما جاء بتقرير اللجنة المذكورة ومناقشته لأخذ الرأي على مواد القانون مادة مادة.
