يدور موضوع الكتاب حول أدلة الإثبات المتعارضة في الدعوى المدنية والتي تعتبر من الوسائل المقبولة قانونياً التي يلجأ إليها اطراف النزاع لإقناع القاضي بصحة الوقائع التي يدعونها.
من هنا تنطلق أهمية البحث حيث أن القاضي وصاحب الحق والناس بحاجة ماسة إلى وسائل الإثبات، لأن القاضي لا يستطيع الحكم من دون دليل صريح، وصاحب الحق لا يمكنه الإحتفاظ أو الحصول على حقَه من دون دليل، وكذلك الناس لا يمكنها المحافظة على حقوقها إذا لم يكن هناك اداة أو أسلوب ممثل بالدليل أو الوسيلة الثبوتية الواضحة لتأكيد الحق ودفع الشبهة.
يتناول الباحث هذا الموضوع بشكل مستفيض ويبحثه بالإعتماد على الفقه اعتماد كتب التفسير وكتب الحديث وكتب أصول الفقه، أما بالنسبة لعرض المسألة في الفقه القانوني فقد تمَ اعتماد آراء فقهاء القانون في ظل القانون المدني وقانون الإثبات، مع محاولة الربط الموضوعي بين كتب القانون القديمة والحديثة لمعرفة مدى التطور الذي تمليه حاجة المجتمع.
ما أولى خطوات البحث هو تعريف الإثبات والدليل وانواعه مع بيان مفهوم التعارض والترجيح ثم التحوَل إلى مفهوم عبء الإثبات والقواعد العامة مع محاولة لإظهار الجانب التطبيقي العملي لمفهوم التعارض والترجيح وعبء الإثبات والقواعد العامة في الإثبات.
