الصك إحدى الوسائل التي افرزها العرف التجاري لتكون أداة وفاء تقوم مقام النقود، وأصبح وسيلة حضارية للوفاء بالإلتزامات وبديلاً عن نقل النقود، ولأهمية دوره في متطلبات الحياة التجارية تدخلت التشريعات في أغلب الدول لتنظيم أحكامه، وكذلك فعل المشرع التجاري الليبي، بل وإمعاناً في حماية وظيفته بوصفه أداة وفاء مقام النقود تدخل المشرع الجنائي الليبي بحماية الصك شأنه شأن بعض التشريعات، إلا أنه مع مرور الزمن آثار التطبيق العملي إشكاليات أصبحت مثار جدل بين الفقه والقضاء، وانعكس ذلك بدوره على التطبيقات القضائية، وقد حاولنا من خلال هذا الكتاب تناول أحكام الصك في القانونين التجاري والجنائي مسترشدين بأحكام القضاء وآراء الفقه المقارن، كذلك التطبيقات القضائية الحديثة بغية تسليط الضوء على تلك المسائل المثارة.
وقد قسمنا الكتاب إلى سبعة فصول هي:
الفصل الأول "تعريف الصك" ، الفصل الثاني "أطراف العلاقة القانونية للصك المصرفي" ، الفصل الثالث "الشروط الواجب توافرها في الصك المصرفي" ، الفصل الرابع "تدوير الصك" ، الفصل الخامس "تقديم الصك للوفاء" ، الفصل السادس "المعارضة في الوفاء بقيمة الصك" ، الفصل السابع "الرجوع بسبب عدم الوفاء" ... آملين أن نكون قدمنا من خلاله ما قد يكون عوناً للمتعاملين بالصك من رجال القانون والمهتمين بالمسائل التجارية.
