اتسع الخلاف وامتد بامتداد الفتوح واتساع البلاد ودخول أمم مختلفة العادات والأفكار في الدين الإسلامي. وظهر في ذلك الزمن كثير من المجتهدين الذي عنوا بالفقه وتعليمه فكان لكل منهم يسبب ذلك مذهب خاص ينسب اليه، اتبعه كثير من العامة والمتعلمين الذين أيدوه ونشروه ومن هذه المذاهب ما لم يتح له عوامل البقاء والانتشار فاضمحل ودرس كمذهب الأوزاعي بالشام ومذهب الظاهرية ببغداد ومذهب الحسن البصري بالبصرة ومنها ما بقى ومذهب الشافعي (150- 204) ومذهب أحمد بن حنبل (164- 241) ومذهب الزيدية في اليمن والإمامية في إيران والعراق والاخيران من مذاهب الشيعة.
وليس الخلاف بين هذه المذاهب خلافا على الأصول والمادى ولكنه خلاف في الفهم وطريقة التطبيق.
ولما كان القصد إلى دراسة المعاملات المالية وكان محلها المال واساسها الملك والعقد كان كتابنا في التعريف بالمال وفي بيان الملك والعقود المالية وسيكون الساس بيان مذهب الحنفية فإذا وجدنا حاجة إلى بيان غيره ذكرناه مع نسبته إلى صاحبه.
