تأثر القانون المصري المتعلق بحماية المنافسة ومنع الممارسات الاحتكارية بالنظام القانوني الفرنسي، في صياغة القواعد التي تضبط ممارسات المشروع ذي الوضع الاقتصادي المسيطر في السوق التنافسية الذي يكسبه مركزًا احتكاريًا، بما يمنع هذا المشروع- وفقًا لوصفنا- من التعسف في ممارساته الاحتكارية أو- على حد الصياغة الفرنسية- من إساءة استخدام وضع السيطرة الذي يتمتع به أو يستغل حالة التبعية الاقتصادية، وهو ما يجعلنا نعول على التطبيقات الفرنسية في هذا الصدد.
وقد آثرنا أن نبدأ دراستنا هذه بموضوع تنظيم المنافسة كخطوة أولى لضبط السوق التنافسية بين المشروعات التجارية، على أن يعقب ذلك موضوع حظر استغلال الأشخاص ذوي السيطرة لوضعهم المسيطر، وبذلك تكتمل منظومة حماية المنافسة. فحماية المنافسة- في نظرنا- لا يمكنها أن تحلق فوق سوق تنافسية إلا بجناحين: تنظيم المنافسة وحظر إساءة استخدام الوضع المسيطر.
