المراد بعنوان الكتاب هو: إرجاع المبادئ القانونية الحديثة إلى أصولها الشرعية التي تدل عليها آيات قرآنية كريمة، أو أحاديث نبوية شريفة، أو إجماع العلماء، أو الفقه الإسلامي بشكل عام.
وقد نهضت هذه الدراسة من أجل معالجة الإشكالية المتفاقمة بين متزمتي القانون الوضعي ومتشددي الشريعة الإسلامية، من تهميش كل فريق للآخر، وذلك من خلال إثبات ان هذه المبادئ القانونية التي هي محور الدراسة، هي مبادئ شرعية قبل أن تكون وضعية، أملاً بذلك تضييق هوة الخلاف بين كل من التيارين المختلفين.
واشتملت الدراسة على أربعة فصول، يتقدمها فصل تمهيدي: أما الفصل التمهيدي: فقد خصص لــ (التعريف بمصطلحات عنوان الموضوع)، ويتناول فيه شرح وتحليل المفردات الواردة في العنوان، وبيان علاقتها بالموضوع، والمراد منها في هذه الدراسة خاصة.
وأما الفصل الأول: فقد عقد لــ (تأصيل المبادئ المتعلقة بشرعية القوانين وسريانها)، ويعرض فيه المبدأ الذي يتم من خلاله تحديد الإطار العام للأفعال الإجرامية، والعقوبات المقررة جزاء عليها، والمتمثل في (مبدا الشرعية الجنائية)، ويعرض فيه أيضاً مبدأ سريان قانون العقوبات من حيث الزمان والمكان.
وأما الفصل الثاني: فقد أفرد لــ (تأصيل المبادئ المتعلقة بخصائص العقوبة وحالات الجهل بالقانون)، ومعرض الحديث فيه يكون عن مبدأ شخصية العقوبة ومبدأ المساواة فيهان ومبدأ عدم جواز الإحتجاج بالجهل بالقانون وبالوقائع أو الغلط فيهما.
وأما الفصل الثالث: فقد خصص لــ(تأصيل المبادئ المتعلقة بأسباب الإباحة)، ويتناول فيه الحديث عن الظروف التي تحيط بالفعل غير المشروع فتجعل هذا الوصف منتفياً، والظروف التي تؤثر على الفعل فتنفي عنه الصفة الإجرامية وتعيده إلى أصله المباح تسمى بــ (أسباب الإباحة)، كمبدأ أداء الواجب، وإستعمال الحق، والدفاع الشرعي.
وأما الفصل الرابع: فقد أفرد لـ (تأصيل المبادئ المتعلقة بموانع المسؤولية)، ويجري الحديث فيه عن الأهلية الجنائية والتي تتمثل في قدرة الشخص على الإدراك والإرادة، فإذا ما تعرض هذا الشخص لظرف يؤثر على إدراكه أو إرادته بحيث يقدم على إرتكاب جريمته وهو غير مدرك لما يفعل أو غير مريد، فإنه لا يكون محلاً للمسائلة الجنائية، كالصغير والمجنون والمكره.
