إن لظاهرة التعذيب اليوم إنتشار كبير على الصعيدين الدولي والداخلي وإن لهذه الجريمة تأثر مباشر وسريع وشامل بحيث له جوانب سلبية على الضحية (الذي تلقى التعذيب بشكل مباشر) وعلى المجتمع المحيط به وقد توغلت هذه الجريمة في مقاصدها وأصبح الإعتراف أو المعلومات ليس هو الهدف الأساسي من وراء التعذيب ولذلك لا بد التحري في الأركان الحقيقية والأهداف المرسومة لهذه الجريمة.
من هنا، سوف يتناول الكتاب في المبحث التمهيدي التأصيل التاريخي لجريمة التعذيب ماراً بالعصور القديمة في وادي الرافدين ومصر الفرعونية وبلاد الأغريق والرومان وكذلك العصور الوسطى والعصر الحديث مع توضيح تجريم هذه الجريمة في الشريعة الإسلامية والشرائع السماوية الأخرى وآراء الفقهاء والمحدثين حول التعذيب وأخيراً تجريمها في الدساتير والتشريعات الداخلية والمواثيق الدولية.
أما الفصل الاول فقد تناولنا فيه مفهوم هذه الجريمة وتعاريفها وأسباب إرتكابها وكيف نميزها عن الجرائم التي تتشابه أركانها وظاهرها من التعذيب مع توضيح لنقاط الإختلاف والتشابه.
أما الفصل الثاني فقد اختص بأركان جريمة التعذيب العامة والخاصة، بينما سنعالج في الفصل الثالث والأخير العقوبات التي تفرض على مرتكب هذه الجريمة والعقوبات التبعية والتكميلية والمسؤولية المدنية المترتبة عليها، وأخيراً الخاتمة.
