يتناول هذا الكتاب شرحاً موجزاً مبسطاً للأحكام التي قررها قانون أصول المحاكمات الجزائية المعدل، فيقف على الإجراءات المقررة في هذا القانون والواجب إتباعها عند النظر في الشكوى والأخبار عن الجريمة والبحث عن مرتكبها والتحقيق معه ومحاكمته وفرض العقوبة بحقه ومن ثم تنفيذها.
وفي سبيل ذلك فإنه يعرض للأحكام الخاصة بمجموعة الإجراءات التي تتخذها محاكم الجزاء بإعتبارها ممثلة للدولة بحق الأشخاص الطبيعيين والمعنويين إذا ما اقترف أحدهم أي من الأفعال التي تعدها القوانين العقابية جريمة، منذ لحظة وقوع هذه الأفعال وحتى صدور حكم بات أو قرار نهائي بحق مقترفيها، سواء صدر هذا الحكم بالبراءة أو الإدانة فتنقضي الدعوى الجزائية عندئذ بهذا الحكم أو القرار.
وبناءً على ذلك فقد اعتمد هذا التبويب نفسه الذي اعتمده قانون أصول المحاكمات الجزائية والذي قرر فيه الإجراءات الواجب إتباعها خلال سير التحقيق والمحاكمة.
وإكمالاً للفائدة فقد جاء شرح النصوص معززاً بالقرارات محكمة التمييز الإتحادية ومحكمة تمييز إقليم كردستان العراق بالإضافة إلى قرارات محاكم الإستئناف بصفاتها التمييزية.
