يعد "قانون حماية البيئة" من أفرع الدراسات القانونية الوليدة، بالنظر إلى أن مشكلات تعدي الإنسان على البيئة والوسط الطبيعي اذي يعيش فيه مع غيره من الكائنات الحية، لم تتفاقم مخاطرها إلا مع بداية النصف الثاني من القرن العشرين. وقد انعكس ذلك على المعالجة القانونية لتلك المشكلات. فلم يتنبه الفكر القانوني إلى هذه الأخيرة، إلا منذ أقل من عقدين، فقط من الزمان، فالبحوث القانونية حول الحفاظ على البيئة، ومكافحة تلوثها، وأشكال التعدي عليها، لم تزل في مهدها الأول، ولا يوجد كتاب فقهي شامل يقدم الأصول والمبادئ العامة لحل المشكلات القانونية لحماية البيئة. وقد يرجع السبب في ذلك إلى عدم فرض مادة قانون حماية البيئة كمقرر دراسي في الجامعات، وعلى كل حال، فإنه بالرغم من حداثة ميلاد مادة "قانون حماية البيئة"، والندرة الملحوظة في الكتابات القانونية حولها، فإن المؤلف الذي أقدمه اليوم للقارئ المهتم بشئون وقضايا البيئة، عموماً، ولرجال وطلاب القانون، بوجه خاص، يجمع بين دفتيه دراسة تأصيلية للأنظمة الوطنية والاتفاقية في مجال حماية البيئة، وإذا كنت قد أوجزت الرأي والنقاش النظري، فذلك لأن الأمر يتعلق بميدان يتسم بوعورة مسالكه، ودقة موضوعاته. فالمادة العلمية والوثائقية نادرة، والكتابات التي تناولتها قليلة ضئيلة.
