تمحورت الدراسة في هذا الكتاب (أحكام وقواعد المخاطر غير التجارية وإنعكاسات الضمانات والعوائق الإستثمارية عليها) دراسة مقارنة، في ضوء أحكام قانون الإستثمار العراقي النافذ رقم 13 لسنة 2006، حول دور الإستثمار الأجنبي في تنمية إقتصاديات كل من العراق ومصر لما تعانيه هذه الدول من نقص في رؤوس الأموال والخبرة التكنولوجيا.
حيث الإستثمارات الأجنبية تطرح معادلة صعبة وهي إن المستثمر الأجنبي قلق ومتردد ورأس المال الوافد غالباً ما يوصف بأنه جبان ويحتاج إلى ما يطمئنه من المخاطر غير التجارية، مبيناً ماهية الإستثمار الاجنبي وأنواعه والشكل القانوني الذي يتخذه.
والأخطار غير التجارية التي من الممكن أن ترافقه مثل خطر (التأميم - المصادرة - نزع الملكية - فرض الحراسة - الإستيلاء الجبري - والإجراءات ذات الطبيعة المماثلة) وموقف القانون من هذه المخاطر، وسبل حماية الإستثمارات الأجنبية منها، كالتأمين ضدها ومدى توافر الضمانات المقررة بموجب قانون الإستثمار العراقي رقم 13 لسنة 2006 وقانون الإستثمار المصري رقم 8 لسنة 1997، كالضمانات القانونية والمالية والتسهيلات الإدارية وسبل فض النزاعات التي من الممكن أن تثور بين الطرفين مستقبلاً، ومحاولة الحد والقضاء على المعوقات التي تواجه المستثمرين مثل المحددات (القانونية - المالية - الإقتصادية - الإدارية - الإجتماعية - القيود التشريعية الفساد الإداري والمالي).
وفي نهاية الكتاب تم إستخلاص بعض الإستنتاجات والتوصيات التي رأيتها مناسبة في جذب المزيد من الإستثمارات الأجنبية إلى بلدي المقارنة.
