أفرد قانون العقوبات الباب السابع من الكتاب الثالث (الخاص بالجنايات والجنح التى تحصل لآحاد الناس) لأحكام جريمة شهادة الزور ( مواد من 294-300) ونص فى المادة 301 فى نهاية الباب على عقوبة اليمين الكاذبة لما لها من صلهوثيقة بالشهادة بصفة عامة.
وجريمة شهادة الزور من الجرائم البالغة الخطورة لما يترتب عليها من آثار قد تعصف ببرىء أو تبرىء مذنباً مما يساعد على استشراء الفساد والافساد لهذا فإن جميع الأديان والشرائع القديمة منذ ظهر الإنسان على وجه الأرض تؤثم الشهادة الزور وترى فيها مخبثة أخلاقية تمس كيان المجتمع حتى أن الشريعة الإسلامية وهى الدين الخاتم تناولت هذه الجريمة بإعتبارها منكراًمن الكبائر يتعين تجنبه حماية للفرد والمجتمع فى آن واحد.
وإذا كان شراح القانون الجنائى قد تناولوا بالشرح بعض الحجرائم الهامة وخصصوا لها أبحاثاً مستقلة الا أن جريمة شهادة الزور- فيما نعلم- لم تحظ بهذا الإهتمام بل جرى تناولها فى مراجع شرح قانون العقوبات القسم الخاص وهو ما دفعنا للتصدى لإفراد هذه الدراسة المتخصصة والمتعمقة من الناحية الفقهية مع ايراد مبادىء محكمة النقض فى خصوص هذة الجريمة فى مائة عام حتى تكتل الفائدة المرجوة من هذا البحث الذى نسأل الله جل جلاله أن يكون عوناً للزملاء والمشتغلين بالقانون.
