في الفترة من عام 1981 حتى نهاية عام 2000 حدثت تغييرات جوهرية في السياسة الإقتصادية والإجتماعية واكبتها برامج خصخصة شركات القطاع العام وصدور قوانين الإستثمار والتحكيم وانضمام مصر لاتفاقية الجات وكات هذه الظواهر من المبررات التي سيقت كذرائع لإصدار قانون جديد للعمل لتحقيق ما يسمى بإعادة التوازن وسد الفجوات بين طرفي العلاقة في القانون الحالي، وقد تأخر صدوره طيلة هذه الفترة بسبب ما تتضمنه بعض نصوصه من مثالب وانتقاص من حقوق العمال وإطلاق الحرية المطلقة لأصحاب الأعمال في تخفيض الأجور والاستغناء الجماعي عن العمال ومع ذلك فإن القانون لا يخلو من بعض المزايا على نحو ما سيرد شروح لنصوصه.
وتجرى خطة الموسوعة على أساس إيراد النص القانوني الجديد مع ترجمته باللغة الإنجليزية غير مقيدين بالطريقة التقليدية في التبويب وإنما آثرنا المسلك الحديث في التأليف الذي ظهر في الفقه الأجنبي وخاصة في فرنسا وهو التقيد بتسلسل المواد ثم التعليق على كل نص بآراء الفقه واحكام القضاء وإيراد نصوص القرار الوزاري المنفذة وشرحها وعرض النصوص المقارنة.
