مما لا شك فيه أن موضوع الجرائم المصاحبة للانتخابات لم يتم بحثه بطريقة تتناسب مع أهمية وخطورة هذه الجرائم على الحياة السياسية وممارسة الديمقراطية داخل البلاد، وما قد يترتب عليها من آثار في غاية الخطورة على المصالح العليا لها، وأستطيع القول أن الدراسات السابقة في هذا الموضوع لم تكن بالعمق الوصفي أو التحليلي الذي يتناسب معه، إذ اقتصرت على بيان أو رصد أنواع هذه الجرائم والحماية الإجرائية الخاصة بها ومقارنتها ببعض الأنظمة الوضعية الأخرى المعاصرة.
وقد اعتمدت في هذه الدراسة على المنهج التحليلي المقارن وفقًا لما تقتضيه طبيعة كل جريمة من تلك الجرائم، سواء كان ذلك في منظور الشريعة الإسلامية وذلك باتباع الأسلوب التحليلي المقارن لكل جريمة في القرآن الكريم والسنة النبوية ومقارنة آراء المذاهب الفقهية ودراسة أركان كل جريمة، أو كان ذلك في منظور القانون الوضعي بدراسة النصوص التشريعية ورأكان كل جريمة ومقارنتها بالشريعة الإسلامية، ودراسة أوجه القصور في المعالجة التشريعية وسبل مواجهتها.
لقد قسمت هذا البحث إلى مقدمة وفصل تمهيدي وبابين وخاتمة. وقد خصصت الفصل التمهيدي لتناول تعريف الجريمة في إطار الشريعة الإسلامية والقانون الوضعي، وبيان العملية الانتخابية وتعريف وطبيعة الجرائم المصاحبة للانتخابات، وقد خصصت الباب الأول لبحث الجرائم المصاحبة لمرحلتي القيد بالجداول والدعاية الانتخابية، والباب الثاني لبحث الجرائم المصاحبة لمرحلة الاقتراع والفرز وإعلان النتيجة.
